Complete guide to the RITE regulation: what your business needs to know

The Building Thermal Installations Regulation (RITE) is the standard that governs the design, installation, maintenance and inspection of all HVAC, heating and domestic hot water systems in Spain. Compliance is not optional: it affects any business with thermal installations, from a small office to a large industrial warehouse.

The latest RITE update, published via Royal Decree 178/2021 with subsequent amendments affecting adaptation deadlines, has tightened energy efficiency requirements, expanded documentation obligations and reinforced the inspection regime. This article covers everything you need to know to ensure your installation meets the current regulation.

Scope of application: who is affected

The RITE applies mandatorily to:

  • New installations for HVAC, heating and DHW in newly constructed buildings.
  • Refurbishments of existing installations when the generating equipment is modified, the energy source is changed or the system is significantly extended.
  • Maintenance and operation of all existing thermal installations, regardless of age.
  • Periodic inspections of installations with output above the established thresholds.

Industrial process installations used exclusively for manufacturing are excluded, although working areas within industrial warehouses are subject to the RITE.

Core technical requirements

The RITE is structured around four basic requirements that every designer, installer and installation owner must understand:

IT 1: Design and sizing

  • IT 1.1 - Comfort and hygiene: the installation must guarantee the required indoor temperature, humidity and air quality conditions. Design operative temperatures are 21-23 C in winter and 23-25 C in summer for sedentary activities.
  • IT 1.2 - Energy efficiency: sets minimum seasonal performance levels for heating and cooling generators, installed capacity limits, mandatory heat recovery for air flow rates above 0.5 m3/s, and energy metering in installations exceeding 70 kW.
  • IT 1.3 - Safety: requirements for plant rooms, fire protection and Legionella prevention.

IT 2: Installation

Requires the installation to be carried out by a qualified, registered installer. Upon completion, the installer must issue the installation certificate.

IT 3: Maintenance and use

Defines mandatory maintenance operations, frequencies and the qualifications required of the personnel carrying them out. This is detailed further below.

IT 4: Inspections

Establishes the regime of mandatory inspections by Authorised Control Bodies (OCA). Deadlines and intervals are described in the following section.

Mandatory inspections: deadlines and thresholds

Periodic inspections are one of the most significant obligations for businesses. The frequency depends on the installation’s rated useful output:

Inspections must be performed by an accredited Authorised Control Body (OCA). The result is documented in a report that includes the installation’s energy efficiency rating and, where applicable, the deficiencies found together with deadlines for remediation.

Mandatory maintenance under the RITE

The RITE classifies installations into two categories for maintenance purposes:

  • Installations rated between 5 kW and 70 kW: require minimum maintenance performed by a qualified maintenance company, following the operations and frequencies set out in IT 3.
  • Installations rated above 70 kW: require a maintenance director (qualified technician) and a documented preventive maintenance programme aligned with manufacturer instructions and regulatory requirements.

Required documentation

Every thermal installation governed by the RITE must have the following documentation:

  • Technical project or report signed by a qualified technician, as appropriate to the output level.
  • Installation certificate issued by the qualified installer.
  • Maintenance logbook recording all operations performed, dates, signatories and results.
  • Inspection reports from the OCA, together with any corrective actions taken.

Missing documentation is one of the most common deficiencies found during inspections and may prevent access to energy efficiency grants.

Penalties

Non-compliance with the RITE can result in administrative penalties classified at three levels:

  • Minor offences: missing maintenance logbook, delays in non-critical reviews. Fines of up to 600 euros.
  • Serious offences: operating without an installation certificate, failure to carry out mandatory maintenance, non-compliance with energy efficiency conditions. Fines of 601 to 60,000 euros.
  • Very serious offences: carrying out work on installations without authorisation, falsifying documents, posing a serious risk to personal safety. Fines of 60,001 to 600,000 euros.

Beyond the RITE’s own penalty regime, non-compliance can generate civil liability in the event of an accident and make it harder to obtain insurance coverage.

Key changes in the current update

The RITE revision has introduced significant changes compared with the previous version:

  • Lowered inspection threshold from 70 kW to 20 kW for energy efficiency inspections, affecting thousands of installations that were previously exempt.
  • Mandatory energy metering in installations above 70 kW, with monthly consumption recording.
  • Mandatory heat recovery in installations with outdoor air flow rates exceeding 0.5 m3/s.
  • Stricter seasonal efficiency requirements for heating and cooling generators, aligned with European ecodesign regulations.
  • Integration with building energy certification, reinforcing the link between thermal installation efficiency and the building’s energy rating.

Steps to verify your installation’s compliance

If you are unsure whether your installation complies with the current RITE, this is the recommended sequence:

  1. Locate the documentation: installation certificate, technical project or report, maintenance logbook and previous inspection reports.
  2. Verify the rated output of your installation to determine your specific maintenance and inspection obligations.
  3. Check whether the periodic inspection is up to date and arrange a new one if required.
  4. Review the maintenance contract: ensure the maintenance company is properly qualified and that the contracted operations cover RITE requirements.
  5. Assess the energy efficiency of your current installation and consider whether an upgrade or refurbishment would qualify for grants.

RITE compliance as an opportunity

Compliance with the RITE should not be viewed solely as an obligation. An installation that meets the regulation is one that operates correctly, consumes what it should and has a longer useful life.
